OFFICIAL RULES OF THE ADOBE CREATIVITY TOUR – EDC MEET ME AT THE RAVE-A-THON PHOTOSHOP CHALLENGE

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram or any other social network or platform. You understand that you are providing your information to Contest Entities, and not to, Facebook, Twitter, Instagram or other social network or platform.

Eligibility: Adobe Creativity Tour – EDC Meet Me at the Rave-A-Thon Photoshop Challenge Contest (“Promotion”) is open only to natural persons who are legal United States of America residents, who are at least twenty-one (21) years old, who have a valid social security or tax ID number, at the time of entry. Promotion may only be entered from and in eligible jurisdictions. Contest Entities, prize providers, and their parent, subsidiary and affiliate companies, employees, agents and suppliers, as well as family members of employees and any spouse, child, brother, sister or parent residing as a member of the same household in the principal place of abode of any employee, agent or supplier are not eligible to enter or win. In the event of a dispute as to the identity of an entrant, the authorized account holder of the account will be deemed to be the entrant (“Entrant”). Administrator may request any potential winner to provide proof that such person is the winner. All potential winners are subject to verification before any prize will be awarded. Subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Participation constitutes Entrant’s full and unconditional agreement to these Official Rules and Administrator’s decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Sponsor: The Sponsor of the Promotion is Adobe Inc. (“Sponsor”). Administrator: The Administrator of the Promotion is Live Nation Worldwide, Inc. (“Administrator” or “Live Nation”).

Sponsor and Administrator are collectively referred to herein as “Contest Entities”.

Timing: Administrator's clock is the official time keeping device of the Promotion. Submission Period and Judging Periods are collectively referred to herein as “Contest Period” and are described below.

Submission Period begins at 09:00 AM Pacific Time (“PT”) on April 24, 2020 and ends at 09:00 AM PT on May 6, 2020.

How To Enter: Via Internet, Participants must go to the Promotion submission page located at https://creativitytour.adobe.com/ and follow instructions on the Promotion page to enter the Contest. To get you started, first select the EDC Meet Me at the Rave-A-Thon Adobe Photoshop Challenge, next select your favorite EDC photo or other design image from the available assets on the Promotion page, download the selected image to your computer or mobile device and show your imagination by creatively altering the image using one of the Adobe Photoshop, Photoshop Express, Photoshop Mix, or Photoshop Fix apps, (the “App”) to create a virtual flyer that will serve as the invite for an EDC virtual live stream. Alternatively, entrants may use their own photo to create a unique image using the App. Be sure to design in either portrait (1080px x 1350px) or landscape (1920px x1080px). If you don’t already have one of the Apps, You can download the App for free on your tablet, mobile device or desktop, by following the steps provided on the Promotion page. Once the unique image is created, you then log in into your Instagram or Twitter account via Share button in the App, export your creative image (“Photo”) from the App, as a post to your Instagram News Feed or Twitter Timeline, tag @adobecreativecloud on Instagram or @creativecloud on Twitter and include the two (2) required hashtags #EDCxAdobe, #Contest ("Hashtags") from your Instagram or Twitter account ("Entry” and/or “Submission"). Entrant's Instagram or Twitter account must be set to public at time of entry and until May 31, 2020 as entries with a private account setting may not be captured.

Contest Entities are not responsible for the functionality of the Instagram or Twitter platforms, including changes that may interfere with the Promotion or the ability of a potential entrant to participate in the Promotion.

To enter, an Entrant must have an App and must be a registered user of Instagram or Twitter. If an entrant does not have the App, entrant must follow instructions during the Submission period to register and download a free 7-day trial of Adobe Photoshop, or entrant may download Photoshop Express, Photoshop Fix, or Photoshop Mix from the Apple App Store, or from Google Play to his/her mobile device or a computer for free. Submissions must be created within the App and cannot be edited with the use of alternate apps, from Adobe or other entities. Entries found to utilize additional apps will be disqualified and not included in the judging period.

If Entrant is not a registered user of Instagram or Twitter, the entrant must visit www.instagram.com or www.twitter.com to register for free. Registration for and use of the Instagram or Twitter platforms is subject to their terms and conditions and Contest Entities have no responsibility with respect to such registration or use. This promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram or Twitter. You understand that you are providing your information to Contest Entities, and not to Instagram or Twitter.

1st Judging Round Period (“Round 1”) begins at 9:00 AM PT on May 6, 2020 and ends at 2:00 PM PT on May 6, 2020. Up to fifty (50) qualifying Submissions will be selected.

2nd Judging Round Period (“Round 2”) begins at 2:01 PM PT on May 6, 2020 and ends at 06:00 PM PT on May 6, 2020. Top twenty-five (25) qualifying Submissions will be selected from the top fifty (50) Submissions selected during Round 1, for the next Judging Round.

3rd Judging Round Period (“Round 3”) begins 09:00 AM PT on May 7, 2020 and ends 2:00 PM PT on May 8, 2020. Top ten (10) Submissions will be selected from top twenty-five (25) qualifying Submissions selected during Round 2, as the top ten (10) Finalists

4th and Final Judging Round Period (“Final Judging Round”) begins 2:01 PM PT on May 8, 2020 and ends 6:00 PM PT on May 8, 2020. One (1) Grand Prize winner, with the highest overall score, will be selected from the top ten (10) finalists selected during Round 3 Judging Period.

Top Nine (9) remaining Finalists, that were selected during Round 3 Judging Period, will be selected as the Second Place Prize winners.

Grand Prize Winner will be announced May 17, 2020 during the live stream.

For all entries: Each Entrant is eligible to submit up to one (1) Entry during the Submission Period, regardless of method or combination of methods of entry or number of entries submitted. Multiple participants are not permitted to share the same email address or other relevant account. Any attempt by any participant to submit more than one Entry by using multiple/different email addresses, identities, registrations and logins, or any other methods will void all participant's entries and that Entrant shall be disqualified. Use of any automated technology or system to participate is prohibited and will result in disqualification. Any automated receipt (such as one confirming delivery of text message or e-mail) does not constitute proof of actual receipt by Administrator of an Entry. Contest Entities are not responsible for lost, late, incomplete, invalid, unintelligible or misdirected registrations, which will be disqualified. All entries shall become the property of Administrator and none will be acknowledged or returned.

During the Contest Period, qualifying Submissions may be posted onto the https://creativitytour.adobe.com/challenges/ps-edc-ls page and viewed by the public. Contest Entities shall have the right to immediately remove any and all Submissions that violate these rules, in the sole direction of the Contest Entities. As conditions of entry into this Promotion, and submitting a Submission, each Entrant:

  1. Warrants and represents that he or she has the written consent, release, and/or permission of each and every identifiable individual person in the Entry to use his/her respective name or likeness to enable inclusion and use of the Entry in the manner contemplated by the Contest Entities and these Official Rules, and can make written copies of such permissions available to the Contest Entities upon request;

  2. Acknowledges and agrees that the Contest Entities may exploit, edit, modify, display and distribute the Entry and all elements of such Entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to Entrant or any third party;

  3. Warrants and represents that his or her Entry is original to the Entrant and has been legally obtained and created, does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party, or violate applicable laws or regulations;

  4. Warrant and represent that your Submission does not contain any unlicensed images;

  5. Agree to conduct yourself with due regard to public conventions and morals, and shall not do or commit any act that might prejudice the Contest Entities during the Submission Period; and In the event you cannot provide all required releases, Contest Entities reserve the right, in their sole discretion, to disqualify the applicable Submission, or seek to secure the releases and clearances for Contest Entities’ benefit, or allow the applicable Submission to remain. You agree that Submissions shall not contain, include or involve any of the following: • Published material under copyright (not owned by you) or contract • Obscenity • Crude, vulgar or offensive pictures, depictions, images, language and/or symbols • Gang signs or symbols • Violence • Explicit sexual activity • Nudity • Illegal drug or alcohol use • Commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos or endorsements • License plates, phone numbers, personal addresses (physical or email or otherwise) • Website or web page links • Derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliation of other people (publicly or otherwise), any assault or threatening of others • Trespass or the violation of other people’s rights or property • Illegal (e.g., discriminatory, harassing) or inappropriate activity, behavior or conduct (e.g., inflicting emotional distress) • Conduct or activities in violation of these Official Rules • Any other content, display, materials and/or images that is or could be considered inappropriate, unsuitable or offensive, as determined by Contest Entities, in their sole discretion

Administrator is not obligated to use, publish, display or broadcast any submission materials of an Entry; provided however that each Entrant acknowledges that Administrator will rely on such Entrant's agreement and compliance with these Official Rules when Entrant submits or attempts to submit the Entry and qualify for judging.

Prizes: 10 Finalist Prizes

1 Grand Prize, 9 Second Place Prizes

One (1) Grand Prize consisting of a Rock Flight®, which includes four (4) 3-day VIP passes to EDC Las Vegas in Las Vegas, NV scheduled to take place from October 2, 2020 through October 4, 2020; round-trip, coach class air transportation for four (4) from the major airport nearest prize winner’s home within the U.S. to the major airport nearest the festival; one (1) double occupancy standard hotel room for four (4) nights / five (5) days; one (1) nine hundred dollars ($900) check; winning Grand prize Entry will be printed out as a flyer and will include a personal message from Pasquale Rotella, founder of EDC, to the winner; and twelve (12) months subscription to Adobe Creative Cloud All Apps Plan. Selection of airline, hotel, and any seat and/or room assignments are at the discretion of Live Nation, airline and/or hotel personnel. All other expenses not specifically mentioned herein are solely the winner’s responsibility. Live Nation reserves the right to provide ground transportation in lieu of air transportation if the winner resides within two hundred (200) miles from Festival venue. Winner and guest must abide by all venue/Festival policies. Live Nation reserves the right to revoke full or partial prize from any winner or winner’s guest who it or venue/Festival personnel deem may, in its sole discretion, be intoxicated, be a safety risk, have violated any venue/Festival policy or law, or may bring Live Nation into disrepute. Winner will be required to provide a credit card to hotel to cover incidentals which are not included in prize package. Travel must take place on the day prior to the Festival and return the day following the Festival; no alternative travel dates are available. If winner is unable or unwilling to travel on the dates specified, the prize will be forfeited and may be awarded to an alternate winner. All travel is subject to availability and restrictions. Winner and travel guest must travel on same itinerary and must be at least twenty-one (21) years old. Winner and travel guest must sign and return a travel release before any ticketing of travel occurs. Winner and guest must have all necessary identification and/or travel documents (e.g., a valid U.S. government issued passport, or a valid state-issued driver’s license or Real ID-compliant license or ID, as applicable) required for travel. Winner and guest understand that there are inherent risks involved in travel and that these risks may be present before, during and after the trip. Sponsor and Administrator are not responsible for changes in schedule of any element of the prize or for any expenses incurred as a consequence of flight cancellation or delay. Sponsor and Administrator are not responsible and will have no liability if the winner and/or his/her guest is for any reason not permitted to travel by the relevant airport authorities or misses a flight or other travel element. An unclaimed and/or unused prize element will remain the property of Live Nation. Resale of tickets is prohibited. Approximate Retail Value (”ARV”) of the Grand prize is: Nine Thousand Four Hundred Dollars and Cents ($9,420) depending upon winner’s point of travel origin and airfare fluctuations at the time of taking the trip. Any difference between stated approximate retail value and actual value of prize will not be awarded.

Nine (9) Second Place Prizes each consisting of one (1) four hundred dollars ($400) check, each Second Place winning Entry will be featured during the live broadcast on one of the nine massive stages; and three (3) months subscription to Adobe Creative Cloud All Apps Plan. ARV of each Second Place prize is: Five Hundred Fifty-eight Dollars and Ninety-seven Cents ($558.97).

For all prizes: There will be only one prize per winner. Lost or stolen prizes will not be replaced. Prize does not include any other item or expense not specifically described in these Official Rules, and any such additional expenses are the sole responsibility of winner. Prizes may not be transferred or assigned. Only listed prizes will be awarded, and no other prizing or substitutions will be made. Notwithstanding the foregoing, if a prize includes tickets to an event and the event is cancelled, Administrator reserves the right to attempt to substitute tickets to a different event or the same event next 2021 year (and any related travel) or to not award the prize. Winner agrees to accept the prize “as is”, and you hereby acknowledge that Contest Entities have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prize, including express warranties (if any) provided exclusively by a prize supplier that are sent along with the prize. The valuation of any prize stated is based on available information provided to Administrator. The value of the any prize awarded to the Grand Prize winner will be reported for tax purposes as required by law. Grand Prize winner is solely responsible for reporting and paying any and all applicable taxes. Grand Prize winner will need to provide Administrator with a valid W9 form before any prize will be awarded if the prize is $600 or more. A Form 1099 will be issued to the winner for value of prize $600 or more.

Selection and Verification of Winners: All Submissions will be reviewed and judged by a qualified Live Nation design professional during Round 1, and ineligible Submissions will be disqualified. Live Nation design professional will select up to fifty (50) top rated Submissions from all eligible Entries. All Submissions selected during Round 1, will advance into Round 2 and will be judged by qualified Adobe judges, who will select top twenty-five (25) qualifying Submissions for the Grand Prize. Top twenty-five (25) qualifying Submissions will advance into the 3rd Judging Round and will be judged by the qualified Insomniac judge, and Submissions with the highest score will be selected as the top ten (10) Finalists Top ten (10) qualifying Submissions will advance into the 4th and Final Judging Round, and one (1) Submission with highest overall score will be selected as the Grand Prize winner

Grand Prize Winner will be announced during the live stream on May 17, 2020.

All eligible Submissions will be given a rating from 1 (not good) to 25 (exceptional), based on: i) Originality & Theme Relevance 50% ii) Creativity & Artistic Expression 50%

In the event of tie, Adobe and Live Nation judges will make the final decision in the selection of the Grand Prize winner based on who was the most creative in the Adobe Creativity Tour – EDC Meet Me at the Rave-A-Thon Photoshop Challenge Promotion, at their sole discretion.

Contest Entities shall contact potential winners via direct message on Instagram or Twitter on or around May 9, 2020. Direct message will come from Adobe Creative Cloud @adobecreativecloud. Selected Entrants must respond to Contest Entities within forty-eight (48) hours of notification or attempted notification by Contest Entities. If an Entrant’s notification is undeliverable or in the event of non-compliance with any of the Promotion rules, the applicable prize shall be forfeited, or in the event the selected Entrant declines the prize, the Entrant who received the next highest overall score during the Judging Period may be selected at Contest Entities' discretion.

Administrator’s decisions as to the administration and operation of the Promotion and the selection of Entrants are final and binding in all matters related to the Promotion. Administrator reserves the right to disqualify any Entrant and may refuse to award any prize to a person who is ineligible or has violated any rule, gained unfair advantage in participating in the Promotion, or obtained Entrant status using fraudulent means.

All potential Entrants are subject to verification by Administrator. Administrator will not accept screen shots or other evidence of winning in lieu of its validation process. Potential Entrants must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. Each potential Entrants will be notified via direct message on Instagram or Twitter. Each potential prize winner may be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release (“Affidavit”) (except where prohibited), which must be received by Administrator before receiving the prize in order to claim a prize (if applicable). If a potential Entrant cannot be contacted, fails to sign and return the Affidavit within the required time period (if applicable), declines the prize or prize is returned as undeliverable, such potential winner forfeits the prize. In the event that a potential winner is disqualified for any reason, Administrator will award the corresponding prize to an alternate winner by selecting the Entrant with the next highest score. All alternate potential winners are subject to all requirements set forth in these Official Rules. Up to three (3) alternate winners will be selected, after which the prize will remain un-awarded.

Publicity: Except where prohibited, participation in the Promotion constitutes Entrants’ consent to Contest Entities’ use of name, social media identity, Submission Photo/Entry, likeness, photograph, voice, opinions, hometown and state for promotional purposes in connection with this Promotion in any media, worldwide, without further payment or consideration.

Privacy: Information submitted by Entrants will be collected by Administrator’s systems based in the United States and such collection will be subject to applicable United States laws. Entrants may withdraw personal data upon request; however, Entrants will be disqualified if personal data is withdrawn prior to the determination of the winning and fulfillment of the prizes. Information submitted by Entrants is subject to Administrator’s privacy policy here. Entrants’ participation in this Promotion constitutes consent for Contest Entities to use Entrants’ personal information solely for the purpose of administering the Promotion and awarding the prizes, unless entrant has opted to receive e-mail communications from Contest Entities. Errors and Unauthorized Activity: In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including without limitation, fraud, virus or other technical problem, or any other reason beyond the control of Contest Entities, Administrator may, in its sole discretion, either: (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; or (b) cancel or terminate the Promotion and, if feasible, award the prizes in a random drawing from among all eligible entries received up to the time of the impairment. Administrator reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of the Official Rules of this or any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Contest Entities reserve the right to seek damages from any such person to the fullest extent permitted by law. Administrator’s failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

Release: Except where prohibited, by participating in the Promotion, you agree to release Contest Entities, prize providers, promotional agencies, franchisees, and each of their respective parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees (collectively “Released Parties”), from and against any and all liability for any claims, costs, injuries, losses or damages of any kind arising in connection with the Promotion, including without limitation (a) the unauthorized or illegal access to personally identifiable or sensitive information; (b) acceptance, possession, use, misuse, or nonuse of the prize that may be awarded; (c) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (d) technical and/or communications malfunctions, errors or failures of any kind; (e) unauthorized human intervention in any part of the Promotion; (f) technical or human error which may occur in the administration of the Promotion or the processing of entries; (g) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Promotion or receipt or use or misuse of any prize; (h) if Administrator must cancel or terminate the Promotion for any reason; or (i) if any prize cannot be awarded due to circumstances beyond Contest Entities’ control. You agree that in any cause of action, the Released Parties’ liability shall be limited to the cost of entering and participating in the Promotion and in no event shall the Released Parties be liable for attorneys’ fees or other legal costs.

You acknowledge that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to a prize including, without limitation, the prize quality or availability.

Disputes: As a condition of participating in the Promotion, you agree that: a) any and all disputes, claims and causes of action arising out of or in connection with this Promotion or any prizes awarded shall be resolved individually, without resort to any form of class action, exclusively by arbitration pursuant to the Rules of JAMS, then effective. See Administrator’s Terms of Use for more information on arbitration requirements; You further agree that under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, any damages whatsoever, including without limitation punitive, consequential, direct or indirect, or any other damages. Contest Entities reserve the right to modify prize award procedures. All issues and questions concerning the validity, construction, interpretation, performance, and enforcement of the Promotion and these Official Rules, or the rights and obligations of you and Contest Entities, shall be governed by and construed in accordance with the laws of the State of California without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the State of California.
